Extension of 'Saved Policies' beyond the three-year period
The Planning and Compulsory Purchase Act 2004 provides for the saving of
policies in adopted or approved local, structure and unitary development
plans for a period of 3 years while progress is made on the preparation of
Local Development Frameworks. Policies in development plans which
were adopted or approved at the commencement date (28 September 2004)
expired on 27 September 2007 unless the Secretary of State made a
direction to extend such policies beyond that date. Policies
in those development plans which were adopted after 28 September
2004 are operative for 3 years from the date of adotion. Planning
authorities who wish to save policies beyond three years must
also obtain a Direction from the Secretary of State to save those
policies. This must be done six months before the policies are due to
expire.
